Nope! That's the answer given to Apple by the International Trade Commission, shutting down its hopes for an emergency ban against HTC products. It's actually one of only a few "No!" responses heard on the legal front lately, as Judge Koh managed to give Apple the ability to halt sales of the Galaxy Tab 10.1 and the Galaxy Nexus pending the outcome of the whole shebang. Now, the U.S. ITC has ruled that HTC can continue to import smartphones while the agency "investigates whether the phones violate an order that the Taiwanese company stop infringing an Apple." The claim is that HTC is still in violation of an order issued in December; the ITC denied the emergency request to have phones like the... Read more...
While netbooks are certainly garnering the majority of the notebook spotlight these days, thin-and-light machines such as Acer's Timeline series and MSI's X-Slim family are making a move for the forefront. Just this week, Lenovo also introduced its first significant foray into the segment, and we have to say, it should provide some solid competition in the burgeoning market. The 14" U450p is a perfect in-between for folks not happy with a cramped ultraportable and not able (or willing, as the case may be) to lug around a full-size 15" notebook. Boasting an expected Intel CULV (Consumer Ultra Low Voltage) platform, the machine can be ordered (and then customized) in two main flavors. The first... Read more...
Sharp claims that its new AQUOS DX series of LCD TVs are the world's first LCD TVs with built-in Blu-ray recorders. On the other end of the spectrum, about 2 hours and 10 minutes of the highest-quality video can be recorded on a 25GB BD. You can start recording to disc in as little as three seconds after a disc is inserted,... Read more...
Pre-sale demand for the T-Mobile Android G1 is so high that according to T-Mobile, they have sold out all their units. While we don't know exactly what the number of units is, which makes it hard to just just how impressive this may or may not be, according to T-Mobile, this happened after they tripled their original factory order. Sorry to say, this means if you hope to be one of the ones who gets his T-Mobile G1 on the first day --- and you haven't ordered yet --- you're out of luck. However, you can still get into "round 2" of the pre-orders, according to their site. T-Mobile customers can get a T-Mobile G1 starting at $179.99, plus taxes and fees (pricing subject to upgrade eligibility criteria:... Read more...
You may recall the case of Sebastien Boucher?  He was stopped in 2006 while crossing the U.S. - Canadian border and charged with transporting child pornography on his laptop across the border.  Unfortunately for the prosecutors, the data on the laptop is encrypted, and he now refuses to enter the necessary password to allow access to the files.  Additionally, a judge ruled late last year that he could not be compelled to reveal the password.Based on this ruling, and the recent policies enacted by the Department of Homeland Security, might we see more interest in disk encryption? A pair of DHS policies from last month say that customs agents can routinely--as a matter of course--seize,... Read more...
Since moving to the "top of the world," everything Apple does is watched - and watched carefully.  With iPhone launches done (though iPhone shortages still of interest), some have turned their eyes toward the more mundane portion of Apple's business: the computer portion of it.  And some circuit board orders are being pointed as a possible clue of new MacBooks. The Commercial Times reported (in Chinese, but translated by Digitimes) that Apple has increased its orders of printed-circuit boards for notebooks by 20 percent, compared to last quarter.Macs are selling pretty well lately, but that's a stronger boost than would be expected from the usual seasonal patterns, and it's unlikely... Pure Digital came out of nowhere last year with one of the hottest consumer electronics devices on the market. Their compact Flip Camcorder cost just $149,  had four buttons and a hatch for a couple of alkaline batteries, took pretty good quality video, and plugged right into your USB port to download the video bits of your life. Simple, easy, fun, and inexpensive quickly added up to almost a million units sold, and an instant 20 percent market share. They even let you upload your video direct to YouTube with the software interface included. Pure Digital isn't resting on its success, though; it's come out with a second, even smaller and simpler unit they call the Flip Video Mino.  The... Read more...
Internet years go by fast. Way back in ancient web history --2001-- Borders books thought it was a good idea to ally themselves with a fast-growing web portal called Amazon.com. Perhaps you've heard of it. I'm sure it seemed like an interesting sideline revenue stream to Borders enormous brick-and-mortar book sales at the time. Borders has now finally woken up to the fact that Amazon is basically putting Borders' regular stores out of business, and they're trying to recapture sales revenue currently lost to the Internet by launching their own e-commerce site, borders.com. “The decision to partner with Amazon, at the time it was made, was made I think for very good reasons,” said Kevin Ertell,... Via Technologies, and their subsidiary, Centaur, think their next generation 64-bit processor, the Isaiah, will outperform Intel's soon to be released Silverthorne chip. Glenn Henry of Centaur hedges his bet a little, as hard info about Silverthorne's capabilities is hard to come by. And he says Isaiah won't be able to match a Core 2 Duo. But in the niche of low power consumption/high performance/inexpensive processors, Isaiah's "out-of-order" processor architecture might make Via a winner. An in-order processor is similar to a factory with a single assembly line. The chip can only work on one operation at a time, and other operations must wait for the assembly line to clear before they can be... Read more...
It's finally happened: the first official order for the OLPC has been placed.  The country which ordered them was Uruguay. The South American country has bought 100,000 of the machines for schoolchildren aged six to 12. A further 300,000 may be purchased to provide a machine for every child in the country by 2009. The order will be a boost for the One Laptop per Child (OLPC) organisation behind the project which has admitted difficulties getting concrete orders. An additional boost to the program may happen on November 12th, when the "Give 1, Get 1" program starts, allowing end users to buy their own OLPCs.... A former BitTorrent server administrator has been given a harsh sentence - at least for a diehard Linux user.  Because the monitoring software required by his plea agreement won't run on Linux (surprise!), he is been ordered to switch to Windows, or go without a computer. Scott McCausland, who used to be an administrator of the EliteTorrents BitTorrent server before it was shut down by the FBI, pleaded guilty in 2006 to two copyright-related charges over the uploading of Star Wars: Episode III to the internet. As a result, he was sentenced to five months in jail and five months' home confinement. McCausland — who also goes by the name "sk0t" — has since been released from jail, but on... Read more...
Dominos Pizza has been experimenting with different forms of digitally ordering pizza in recent years.  It all started with opening a web-site to take online orders (something Papa John’s Pizza made quite popular), then moved on to the infamous /pizza command in EverQuest 2, and now has moved on to the wonderful world of SMS.The big question is just who is going to be the target audience for such a method.  It'd seem that anyone with an SMS-capable phone could just make a call, unless the phones at their local Dominos are too busy. “Yes, if you get a passion for pepperoni when the pubs throw out, just go to your phone and send a message. Your pizza will then arrive from one of Dominos' 470... Read more...

Just about everyone has at least heard some tale of neglect with video games and/or the internet to blame.  It seems that the American Medical Association (AMA), even after declining to call gaming an addiction (at this time), wants to study the subject further: “The call to examine gaming and Internet addiction may spawn from the widely reported, but isolated incidents of health issues – and even death – surrounding massively multiplayer online games, such as the World of Warcraft.Aside from addiction, the AMA may also look at the emotional effects of video games dealing with extreme content. Currently under intense scrutiny is Rockstar Games’ Manhunt 2, which has been temporarily suspended... Read more...
The case is long from settled, and there will likely be a littany of appeals and countersuits, but Alcatel-Lucent won the first round in their legal battle against Microsoft and has been awarded a $1.52B (that's Billion) settlement. "A U.S. federal jury found that Microsoft Corp. infringed audio patents held by Alcatel-Lucent and should pay $1.52 billion in damages, the No. 1 software maker said Thursday. Microsoft said it plans to first ask the trial judge to knock down the ruling and will appeal if necessary. It said the verdict is unsupported by the law and that it had already licensed the technology in question from Germany's Fraunhofer."... Read more...

In what seems to be a significant victory in AMDs ongoing Antitrust case, Federal court orders Intel and 3rd Parties to produce Foreign Discovery in AMD vs. Intel U.S. antitrust suit. AMD today announced a significant legal victory in its ongoing antitrust suit against Intel Corporation. In an order effective yesterday, the Federal District Court in Delaware overruled Intel's objections and ordered it to produce documents and other evidence bearing upon Intel's exclusionary conduct outside of U.S. borders. AMD believes that the production of this foreign discovery will contain evidence of anticompetitive business practices that show clear violations of not only the Sherman Antitrust Act but also... Google has partnered with quite a few other nations to provide more content through their Google Video service. "Google hopes that the eight national editions will grow to reflect the likes of the countries each site serves - visitors can rate videos to help sort which ones are the most popular. Included in the list of partners are ITN, Wimbledon video rights holder IMG Media, the Cousteau Society, Talkback Thames, Buena Vista International, FC Barcelona and France's National Audiovisual Archive."
