It seems likely that the outcome of a Samsung suit against Apple would depend upon the location of the court which tries the case. In Lucy Haeran Koh's court located some 16 km (10 English miles) from Apple's headquarters, I'd not give Samsung a snowball's chance in a tropical climate...
