Ah, but what you fail to point out is that ToS has never once held up in court, often requiring very little if any effort on the defense to get the whole thing thrown out. They are not valid legal documents and overly burdon one party. In fact, pretty much every ToS out there will containe several illegal stipulations.

Apple screwed me out of a couple of hundred downloads that i originally purchased with a different username before I joined .mac, now .me. I upgraded my machine and it "forgot" my earlier username, where DRM (Digital Rights Management) made a few hundred dollars of my legal purchases worthless.
Lesson learned. Buy CD's. At least you will have a hard copy back up, and not some scam of a cloud membership.
T&Cs are not legally binding as it's illegal to add terms to a contract after the point of sale. At best, clicking OK is the same as being forced to sign a contract under duress (also, not legally binding)
There are also ways to have Ok clicked, without clicking it. I have a program that enables command buttons for example, in the case where it requires you to check off "I agree" before the button will become enabled, I can click it without clicking "I agree". I use it whenever I can.
Time to hire a lawyer to read my T&Cs for me xD if only LOL
