Lacking any technical means by which to combat the circumvention of their improperly implemented pki security. Sony has filed suit against everyone involved - even though fail0verflow only provided enough info to get Linux running, and not pirate games (Geohot's info, however, could be used for both).
So there you have it. Sony believes it's okay for them to remove advertised functionality (OtherOS) from your console in firmware updates. But if you sidestep their broken security in order to put that functionality back, you're a criminal.
I know which next gen console I won't be buying.
