Less than 24 hours after Oracle named ousted HP CEO Mark Hurd as co-president, HP has filed a breach of contract lawsuit against him. To be honest, if Monday had not been Labor Day, and if the announcement hadn't been made so late in the day, they probably would have filed a lawsuit that same day.

While Hurd didn't sign a non-compete agreement, the lawsuit focuses on confidentiality agreements in his exit package. That package was worth over $40 million, so Hurd will have plenty of money to fight the lawsuit with (although we honestly assume Oracle lawyers might be handling things).

Oracle CEO Larry Ellison, a close friend of Hurd's, criticized HP's decision to oust Hurd.  His resignation came after an HP investigation turned up some irregularities in expense reports concerning a marketing contractor.  HP's decision over Hurd came despite the fact that under his watch, the company's reputation, market share, and financials soared.

HP's own statement in the matter says:
“Mark Hurd agreed to and signed agreements designed to protect HP's trade secrets and confidential information. HP intends to enforce those agreements.”
Oracle's stock was up to $24.26, up $1.34 or close to 6 percent on the day. Meanwhile, HP's stock dropped slightly, $39.93, down $0.41 or just over 1 percent on the day.

Later in the day, Oracle responded with the following statement:
“Oracle has long viewed HP as an important partner,” said Oracle CEO Larry Ellison. “By filing this vindictive lawsuit against Oracle and Mark Hurd, the HP board is acting with utter disregard for that partnership, our joint customers, and their own shareholders and employees. The HP Board is making it virtually impossible for Oracle and HP to continue to cooperate and work together in the IT marketplace."
You can read the lawsuit below.

If Hurd hasnt done anything but accept a job position, why is HP going nuts on this. They didnt want him and let him go, now they dont want anyone to be able to have him. Sounds to me like they need to wait till Hurd does something before they file a lawsuit with a partner company. HP just shot themselves in the foot with this one.

>> While Hurd didn't sign a non-compete agreement...

Of course he didn't, because they only make it a term of employment for us non-management types to sign those. They'd never make a stipulation that the guys at the top had to sign them too and throw away the chance to make millions and millions when they jump ship.

... but ya, he just accepted a job,

“Mark Hurd agreed to and signed agreements designed to protect HP's trade secrets and confidential information. HP intends to enforce those agreements.”

Like this quote, it said to protect HP trade secrets and confidential information... accepting a job does not breach that agreement.

A dog will load up his mouth with bones when he finds a pile of them, and then piss on the rest before he leaves.

Woof-Woof! HP,............

Dogs are great judges of character, and if your dog doesn't like somebody being around, you shouldn't trust them.

Its all a liberal conspiracy man!!

They try and destroy companies that don't support their agendas, then move to the companies that do! I wonder if all the people who have been laid off by HP since the nineties give a flying rat turd about Hurd:P

Yet, I am sure everyone still believes that Demcrates don't lie, Beck is wrong (with Video), and Aliens don't exist!

It still depends on what your definition of is..is?

Animatortom,

I think your dementia's setting in, or mine is, because I can't follow your logic at all.

Mark Hurd's reign has been very good for HP. The CEO who was destroying them was Carly Fiora. You know her - the one that's running for Senate in California as a REPUBLICAN... The one who layed off 15,000 people back in 2002? The one who, by getting fired, cause HP's stock gain 10.5% in a single day?

Insinuating that Democratic CEOs are firing any more people than Republican CEOs, and the Beck isn't loonier than Saturday morning cartoons makes me wonder about your critical thinking. I sincerely hope you weren't one of those old people Glenn and Goldline scammed with their cross-fearmongering/endorsement/200%-overcharging deals.

Well 3v1L you should have figured that out by now since was a looney Tunes animator

I have no sorrow for any of these CEO's who collect millions, and have parachutes. When it is all the other people who do the actual work! I was talking about all the layoffs in the nineties throughout the country at 50K to 80K people at a time.  Blaming Fiorina for HP is kinda like the 9/11 truthers who blame Bush. If it was the Govments fault, then it was the guy in there for eight years who convinced everyone he was so great, when he in fact left under impeachment. It is like if you bought a house and the next day is gets shot full of holes from a drive by, because the previous owners were gang bangers! If you free up all the companies to outsource and earn profits from cheap overseas labour, then stop all military spending by 80%, take any money in surplus savings and give everyone jobs at Best Buy selling those cheap import products! Then yes the economy will LOOK like it is doing better and everything is balanced. That would be like selling everything in your garage, then taking everything in your savings out. Just so you can go on a date to Vegas and make it look like you are a millionaire for the weekend. Then the following week when reality sets in, it becomes someone else's fault that there is no money.

CEO's whether R or D, if they do not understand that their power and money come from the workers underneath them then they have no right being there. Just like Politicians. Yet now we have so many people who Idolize people like Che Guevara and Mao, and think that is cool! That would be like saying I Idolize Hitler and anyone who doesn't is and idiot racist. So no I have not bought into gold, like history I learned on my own and learn all I can! I used to think he was some kind of crazy republican as well. Yet being someone who has always done his own research on history. I know that, Anyone who calls Beck Loony, does not actually watch the show!

I know what is looney is that most people like my parents, only get their news from the daily show and Colbert report!  Now that is crazy!

Either way, I just wanted to get people thinking, and drive the liberals crazy :) we can work on the repubs next:P

>> If it was the Govments fault, then it was the guy in there for eight years who convinced everyone he was so great, when he in fact left under impeachment.

Who left under impeachment? Andrew Johnson? I remember an acquittal some years back, so I'm not sure who you think left office under impeachment.

>> Anyone who calls Beck Loony, does not actually watch the show! [...] I know what is looney is that most people like my parents, only get their news from the daily show and Colbert report! Now that is crazy!

I've watched Beck, and he's loony. His jumps from point A to point B have larger gaps than the science in Dr. Who episodes. I've also watched Stewart and Colbert, and both recently pissed me off (not for the first time) with their treatment of Dr. Laura's free speech. In my opinion, anyone who agrees with any polarized platform is "loony". Of course, I'm a liberal Texan who loves guns... so I'm probably "loony" by others standards.

>> CEO's whether R or D, if they do not understand that their power and money come from the workers underneath them then they have no right being there. Just like Politicians.

Now THERE's something we can agree on.

Oh crap... I just realized that you and I might be socialists.

So what you are basically saying is that we are both Texas Nutsies?

That is the only time socialism has actually worked, and it didn't work out to well for Jew's and other non Germans:p

Remember that Socialism is a precursor to Communism! Whose sole intention is that others must perish for the ones in favor get the power and prosperity.  That is why the word socialist is in almost all communist nations. it is even funny that they also use the word democratic as a way to describe the socialist movement. There is no liberty or freedom in that form of thinking.

Just look at the numbers..http://www.digitalsurvivors.com/archives/communistbodycount.php
And yes Bubba was found guilty and was impeached by the House. Yet his term was up before the proceedings could be completed, and the democratic senate voted against it to hold things up just enough before he left office. So they were able to cover it all up and make it look like he left in good standing.  The lies that left wingers use is never ending. They change the wording to confuse people and make it seem like they do no wrong. Just like the economy back then, they cut 85% of military spending us up all the savings, then make it look like we are doing good. All the while the jobs were being outsourced through new legislation that allowed such underhanded wholesale destruction of our economy.  Now the new admin are just finishing the job!

While I agree that Beck is Overtly Melodramatic, and a tad bit on the evangelical side. But he is just playing to the audience.  Being Atheist, I kinda find it weird to watch him when he starts getting all biblical on us. But like all of his critics, no one has pointed out what he has been wrong about? He is now doing his research that I have been doing since I was a kid. There are always two sides to a story, and when those in power are the ones telling it....Then they will only tell you what they want you to know to serve their own purpose. Remember that History is written by the victors!
He has done a very good job of pointing out what politicians are up to in their own words on video.

We used to have regulations in play that protected the people, that is what the whole Enron scandal was about. Now the same things that those guys got in trouble for are being done within the govmnt and no one seems to notice, because they are good showmen and make you think they are doing it for your own good! They have just gotten better at making you believe that their definition of Is,...Is the right one! Most of those guys should be in the same place as Bernie maddoff!

It is nice to think that socialism could work. But in the world of Sci-Fi is the only place I have seen it work. And on Star Trek, the only reason it does is because they have gotten around some essential aspects of life. Like replicators and transporters so people do not have to worry about the necessities.
