Three Frenchmen Face 5 Years and $700,000 for Running a File Sharing Site

The fight against illegal file sharing sites took a trip to France to this week as the alleged men in charge of one of France's most popular file sharing links forums have all been arrested. The three men accused of copyright shenanigans ran a site known as Liberty Land, which has been in operation since 2009 and was currently serving around 800,000 members at the time it was shut down. If convicted, the three men, none of which are older than 30, could face sentences of up to 5 years behind bars and fines of $700,000.

Liberty Land falls into France's top 200 sites and contains some 30,000 links to albums and 100,000 links to movies and TV shows. The links direct users to third-party downloading services like MegaUpload and RapidShare; none of the illicit content is actually hosted on Liberty Land's servers. Furthermore, according to TorrentFreak, Liberty Land utilized hosting services in Canada because of the way the country's copyright law is structured.

Between Canada's copyright law and measures put in place by the site admins to remain anonymous, authorities described the investigation leading up to the arrests as "difficult," albeit ultimately successful. TorrentFreak says the men may have made as much as $285,300 in revenue from banner advertising on the site, noting that they could be charged with organized counterfeiting.

That is crazy, especially since they are only providing the links not the files themselves!!!! I love the picture of the frog!

How is it illegal to just host the links... Well im not a lawyer so i wouldn't know the law. :D

The laws of this land are far too ambiguous for me to start trying to dissect French law too. If it's illegal there, then they're big boys and probably knew what they were into before they started enabling people to share copyrighted material. Whether it's right or wrong is another matter, and it is, of course, moot.

I thought there were only 3 men accused of the file linking? and yep they did know what they were doing. by posting and sharing the illegal links.

what's surprising is that the site was in the top 200 for some time  & no wonder with that one.

I think Neil was thinking of the two others who are accused of attacking hotel maids :P

I just wonder if they are going to go after the hosts in the middle east like packistan or in Russia, then they might need to turn it into an international incident? Maybe that is why they are going to use Lockheed issue to allow the gvmnt to wag real war when assaulted electronically? If that is the case then why are they not going after China? They have stolen every creative property known to man! I mean seriously, a Chinese Harry Potter with a Communist twist?

That is the main issue. Most of these host sites are coming from the eastern hemisphere and they all tend to think that they deserve it for free. Much like the drug problem, it doesn't do much good to go after the Addict, you must take out the dealer!

To me this is like the Window tint laws. They say it is for the gangbangers and supposed to protect officers. Yet in Cali the only ones getting the expensive tickets are the respectable citizens, even those Mercedes with factory tint more than 5%, while all the gangers still drive around with limo tint! The best solution would be to just stop all international distribution! or at least impose those beloved sanctions on the countries that allow cameras in the theatres?

Since "none of the illicit content is actually hosted on Liberty Land's servers" I don't think the Liberty Land website can be held liable, but then again France is known for doing weird things and being strange and im sure this could apply to their legal system and copyright laws as well :p

I doubt they will get the max sentence of 5 years and $700,000 in fines and most likely they will settle out of court for just some cash. I am sure the site was up for so long because they were trying to build a solid case against the 3 men.
